In an unprecedented agreement, UMDNJ signed a contract with Christie in 2005 to evade legal action by allowing a federal monitor to oversee the university for two years. The federal monitoring agreement was transferred to Rutgers when state university took over UMDNJ Medical and Dental Schools nearly two years ago. “Rutgers is pleased that the five-year enterprise integrity agreement, signed by the U.S. Department of Health and Human Services` Office of Inspector General and the former University of Medicine and Dentistry of New Jersey, has been reached,” said Greg Trevor, a Rutgers spokesman. “Rutgers worked with the federal government to continue the compliance program established under the agreement.” Fraud and abuse systems in the health sector continue to reach record rates and there is no indication that the situation will slow down in the near future. One of the key roles of health compliance officers is to inform the leaders and boards of directors of their organizations of risks that do not comply with all the confusing rules and regulations in the current market. Non-compliance may result in fines and penalties related to STARK II regulation, the Federal Anti-Kickback Act, the False Claims Act and other warrants.
